1. Why we collect tax information
1.1 Canada and the European Union require online platforms to collect information about their sellers and report it to tax authorities once a year. Japan and Korea apply equivalent rules derived from the same international standard. We collect this information because the law obliges us to, not because we choose to. This document is one of the documents listed in section 4.2 of our Terms of Service, and it does not repeat the fees set out in Payments & Payouts.
2. Who this applies to
2.1 Every seller who receives money through Tokyofishmarket. It applies whether you sell as an individual or as a business, and whether you sell once or often, subject to the exclusions each regime provides.
3. What we collect
3.1 Your name, your address, your date of birth if you are an individual, your business registration number if you are a business, your tax identification number and the country that issued it, and the country where you are resident for tax purposes. We also record the money we paid you, the fees we charged, and the number of sales, per quarter.
4. What we report, to whom, and when
4.1 We report the information in section 3 to the tax authority of the country where we are established, which passes it to the tax authority of the country where you are resident. The report covers a calendar year and is filed the following year, on the deadline each regime sets.
5. Your copy
5.1 We give you a copy of the information we reported about you. Check it. If it is wrong, tell us and we correct it with the authority.
6. Sales tax we collect at checkout
6.1 Separately from the annual reporting in sections 3 and 4, we calculate and collect sales tax, VAT, GST, HST or QST at checkout, through our payment provider's tax service, in the places where we are registered or required to collect it, as section 3.5 of Payments & Payouts describes. This does not replace your own tax obligations as a seller, described in section 7.
7. If you do not give us the information
7.1 The law requires us to remind you, and then to stop paying you or to close your seller account if you still do not answer. We tell you before we do either.
8. This is not tax advice
8.1 We report what the law tells us to report. We do not tell you what tax you owe, and we do not file anything on your behalf. Whether your sales are taxable, and at what rate, depends on your own situation. Ask a tax professional.
9. How long we keep it
9.1 We keep the information in section 3 for as long as the law of each regime requires us to be able to produce it.
10. Changes and contact
10.1 We change this document only as section 19 of the Terms of Service allows. Every version is kept and dated. You can read the history from the link at the foot of this page.
